If you don’t think it's possible to write an article incorporating a climate catastrophe story along with the opening bell of an alternative party presidential run story, then you have another thing coming to you! It’s also includes poorly written filks of old tunes as segues. (Sorry about that, but they just seem to fit.) 

In the news climate-wise, people in New York City were forced to give up breathing this past week due to particulate pollution caused by Canadian wildfires. The Air Quality Index (AQI) in parts of Brooklyn reached 484 — nearly double San Francisco’s highest hourly reading during California’s 2020 fire season. And it wasn’t just New Yorkers who were gasping for air. The smoky haze and micro-particulate clouds covered skies from Illinois to Ohio to Pennsylvania to South Carolina to New York State to Maine… In fact, just about everybody east of the Mississippi experienced horrible air quality indices this week.

Who cares though, right? Breathing is for sissies! We're told that unhealthy AQIs can cause serious health issues for vulnerable populations such as asthmatics and those with COPD as well as children and the elderly. But what’s more important—keeping poor working class people alive or growing sociopathic billionaires’ bank accounts? You know which group is more important to please for those idiots in Washington DC and in your own statehouse, don’t you? For your sake, I hope you do.
 
The fossil fuel industry takes no responsibility for causing a build up of carbon monoxide in the atmosphere due to the polluting by-products which come from combustion engines and coal-fueled power plants. It’s not like carbon monoxide and other gases have caused the so-called “greenhouse effect” that bring on heatwaves and dry up the forests of North America. No, not at all. It’s just coincidence that record breaking spring temperatures this year occurred. In no way could they have helped to spontaneously ignite tender-dry forests that have continued to burn unabated for weeks now. Pure coincidence.

It’s also pure coincidence that my garden in Northwest Ohio hasn’t seen a speck of rain in over 21 days—setting a dry spell record that is unheard of in the Midwest since the “Dust Bowl” era of the 1930s. The brown, hazy skies and dry winds that smell like a permanent bonfire have only caused me to reach for my emergency inhaler a dozen times this week. 

Well, who doesn’t need to quit breathing from time to time? The tears streaming down my face from my smoke-irritated eyes can go a long ways in filling our bone-dry rain barrels, too.

If you’re thinking I’m being facetious, think again. Between the millions who are still suffering from the lasting effects of COVID-19 and this recent air quality disaster, who knows just how many Americans have or will suffer a debilitating illness that could disable them for life? The time to take action to eliminate the use of fossil fuels and other polluting methods to generate power isn’t today—it was yesterday. In fact:

A new study by 50 leading scientists conducted to supplement the “information gap” between Intergovernmental Panel on Climate Change (IPCC) reports said global greenhouse gas emissions have soared to a record high and are threatening to push our planet into “unprecedented” global heating.

Which leads me to the next story…

This next story is one that has captured the focus of many a leftist thinker. Dr. Cornel West, academic, philosopher, and former Bernie Sanders delegate to the DNC, has announced that he is running for the presidency in 2024. The biggest controversy at the start of his candidacy is that Dr. West has stated he is running as a People’s Party (MPP) candidate. He’s not running as a Green Party candidate or as an independent but as a candidate for an alternative party that barely exists.

To say this has caused an explosion of conversation and cursing in online forums where Lefties hang out is an understatement. Dr. West’s decision to go with the MPP is being questioned on several levels. Does he realize that the MPP doesn’t have ballot access (or even statewide organizations) in more than a handful of states? Would he be open to becoming a “fusion candidate” that several left-leaning alternative parties such as the Green Party US would be glad to nominate, thus giving him broader ballot access and more experienced organizers? Chris Hedges has said he’d speak to his good friend about switching to the Green Party. Could we see a West/Hedges 2024 ticket? We’ll see.

UPDATE: Chris Hedges did talk to Dr. West and he has decided to run as a Green after all! The West campaign website doesn't reflect this recent change in Dr. West's plans yet, so please be patient.

It’s early days so Dr. West has time to change his mind about running, or he could simply switch his choice in a party and run in one with less controversy attached to it. The MPP has fallen apart (in spite of its auspicious start with West, Nina Turner, Paula Jean Swearingen and other big names supporting it) because of sexual harassment and financial misuse charges brought against its current chair and founder Nick Brana. One would hope Dr. West would address the harassment mess and that Brana would step down so West could run without being associated with any nasty business.

Dr. West is a decent and compassionate human being. He might actually believe the voting public will look past the inadequacies of the People’s Party and concentrate on his message. One would hope that proves true, but for now… The discussions and debates continue online. (UPDATE: Even with Chris Hedges talking Cornel West into running as a Green, things are still relatively up in the air and the discussions are ongoing. You're not going to please everyone, in other words!)

To draw these seemingly radically different stories together—hazy, polluted skies and Cornel West running for office—I’d like to posit that only a presidential candidate of Dr. West’s moral caliber would do anything worthwhile to end the reign of the fossil fuels oligarchs and help put our ailing planet back on a path toward wholeness.

My reasoning? The duopolists take millions of dollars yearly from capitalists who don’t care about the health of the people or our Earth. (I suppose these rich types expect a ticket on Musk’s or Bezos’ rocket to their “Elysium” in space once they’ve destroyed our world.) Leftists candidates like Dr. West would more than likely put the fates of the poor and working classes before the billionaires’ bank accounts.  

During a Cornel West administration, we’d probably see action taken to convert our energy grid from dirty to clean energy sources, along with punitive measures taken against capitalists who don’t cooperate in these lifesaving measures. That’s why it’s imperative those who care about their lungs, their family members’ lungs, and the health of the entire planet leave the duopolists’ ranks and join with independent thinkers to destroy the corrupt, planet-killing system currently in power. 

With cleaner skies, the end of wars for oil, health care for all guaranteed, civil rights assured for the people, we’ll be singing:

Roll out those non-hazy, crazy, lazy days of summer!

(*And you thought I was done with the filks? That’s what a lack of clean air gets you. Bwahaha!)

The New Title 42



The New Title 42

Editor's note: From the "Just when you hoped things would get better for ordinary people" department comes news of what the Biden Administration wants to replace Trump's infamous "Title 42" deportation program with, and yes, it's fairly horrendous

In my day job as an immigration advocate, I have to explain what this new "Asylum/Transit Ban" is to a group of college students in a Powerpoint presentation. Here are my notes--along with a call for action. Everyone who reads this should send in a comment by the March 27th deadline and pass the link along. Lives are at stake.

 

The Biden Asylum/Transit Ban (“The New Title 42”)

What is/was Title 42?  

Title 42 is a public health and welfare statute enacted in 1944 which gives the Centers for Disease Control and Prevention the authority to determine whether a communicable disease in a foreign country poses a danger of spreading in the US. If the CDC finds that a disease does pose a threat, it can, with approval from the president, temporarily prohibit people or property from entering the country to avert danger. It was enacted at the beginning of the COVID-19 pandemic in March 2020. Title 42 is set to expire on May 11, 2023, when the Biden administration states it will declare the pandemic officially over within the United States.  

What’s the big controversy over Title 42? 

Title 42 has been used to prevent immigrants from entering the US and claiming asylum, even though all persons entering the country must show proof of COVID-19 vaccination. Throwing up policy roadblocks to prevent people from entering the country and claiming asylum goes against current US asylum law. There have been 2.5 million expulsions under Title 42. A pattern of discrimination against asylum seekers of certain nationalities, ethnicities, races, indigenous peoples, and LGBTQ+ persons has been noted. 

Expelled migrants from the US southern border have been sent to wait in the northern region of Mexico under the January 2019 MPP (Migrant Protection Protocols) or “Remain in Mexico”. Mexico will take only Department of Homeland Security expulsions of nationals of Mexico, Honduras, El Salvador, Guatemala, Nicaragua, Haiti, Cuba, and Venezuela. All others are either sent back to their country of origin or allowed to proceed through a “normal asylum procedure” in the US. 

(Editor's note: Notice that the more melanin in your skin, the more likely your right to claim asylum in the US will be thwarted. And where these folks are being told to wait in northern Mexico is far from safe and pleasant. What is asylum? 

An asylum seeker meets the same legal standard as a refugee. An individual can claim asylum because of past persecution or fear of future persecution because of race, religion, nationality, political opinion, or membership in a particular social group. 

Congress passed the Refugee Act (1980) to bring the US into compliance with its international obligations under the United Nations 1951 Refugee Convention and its 1967 Protocol, which prohibits returning refugees to any country where their lives or freedom would be threatened. 

On a ruling on Title 42, the 9th U.S. Circuit Court of Appeals pointed out that the Refugee Act is very specific about the circumstances under which the government can deny asylum for failure to apply in a transit country. Under the act’s “safe third country” provision this scenario can happen only if the transit country is safe and has both a robust asylum system and a formal treaty with the United States agreeing to safe third-country status. 

Asylum seekers are supposed to be given a “credible fear interview” by a DHS officer at their port of entry to determine if their asylum claim has validity. If the officer says the claim of asylum is valid, the person can remain in the US while they await their court appearance to present their case before an immigration judge. The Biden administration’s proposed rule will narrow this procedure down to a “reasonable fear interview,” which has a much higher denial rate. If the officer denies the asylum claim, the migrant will be deported. They can appeal this denial, but most do not understand the appeal process and have no access to legal assistance. 

The importance of winning an asylum claim is that it is often the only path most immigrants can take to obtain a Legal Permanent Resident (LPR or “Green Card”) status and eventually become a US citizen. Temporary Protective Status (TPS) or similar statuses are not permanent and do not lead to LPR status or citizenship. 

What is the new “Biden Asylum/Transit Ban” going to do that’s different from Title 42? 

The Biden Administration on February 21, 2023, announced a crackdown on those seeking asylum in the US. The proposed rule would see the rapid deportation of anyone who has not first applied for asylum en route to the US southern border through the use of a smartphone app called “CBP One.” CBP One has been plagued with significant technical problems, preventing many from making “asylum appointments” (two weeks or more out) and has raised serious equity and privacy concerns. The app takes a very long time to fill out and has been known to crash, and the main text is currently available only in Spanish and Haitian Creole, with English only error messages. It cannot be accessed from a computer, and the user must first use an all-English web site, “Log-In.gov,” to set up an account and have their identity verified before accessing and applying for a an asylum appointment via CBP One. 

This proposed rule has been condemned by immigration rights groups, which claim it runs counter to the “humane immigration system” that Biden promised while campaigning for the White House. Some have called it a “hybrid of the Trump transit bans.” It clearly discriminates against those asylum seekers who are too poor to own a smartphone, have no stable internet accessibility, lack computer device skills, or are illiterate. 

The Trump Administration proposed prohibiting asylum for migrants who didn’t first apply for asylum (and been denied) in a country of transit before reaching the US southern border and entering through a port of entry. The court struck down this policy for violating the 1980 Refugee Act, which guarantees the right of all migrants who reach the US to apply for asylum. The Refugee Act expressly permits asylum seekers to access protection anywhere along the border—not just ports of entry—and it does not require appointments to be made in advance on a smartphone only app to request asylum. 

 What problems could this “New Title 42” (Biden Asylum/Transit Ban) cause? 

The proposed Biden Asylum/Transit Ban would create a new asylum restriction for adults and families who present themselves unannounced to US border officials at the southern border. If they have traveled through another country or countries on their way to the US, they would have to provide proof that they applied for asylum in one of the transit countries and been denied first. (One lawyer on a webinar noted that a denial of an asylum application in another country could be used against the person applying for asylum in the US, possibly in violation of the Fifth Amendment.) The Biden administration insists that every asylum seeker has the power to avoid the ban by sticking to what it calls “lawful pathways,” implying that it’s unlawful to seek asylum if you enter the United States between ports of entry (enter without inspection), which goes against the Refugee Act. 

The rule also creates a whole new convoluted procedure to determine whether and how the ban applies. For instance, if you fly into the US, this proposed rule will not apply to you. If you come across the border from Canada, this rule does not apply. Those who have received an advanced parole (and have a US sponsor) or come into the US under a work, student, or tourist visa will not be subject to this rule. The rule only applies to persons who have physically crossed into the United States at the southern border.

The biggest problems arise from the so-called “lawful pathways” that don’t really exist for many people. The process migrants could be shunted into instead is tantamount to a near-complete asylum ban when one considers how the process is intended to work and how it interacts with systems on the ground. And the rule doesn’t even attempt to explain these discrepancies!

Nina! Nina! Nina!

The chant is infectious. The roar of the crowd is deafening. To hear Nina Turner speak in person is electrifying. You just know you're going to hear the truth and it will set you free whenever you're in the presence of one of the progressive movement's most gifted orators.

I remember the first time we caught up with the former Ohio state senator on the campaign trail. It was early 2016. Nina Turner was the "opener" to Bernie Sanders at a Sanders rally at Baldwin-Wallace University, just south of Cleveland proper. It was a cold winter's day, but well worth the trip. Still a relative newcomer to the national progressive scene, Nina's straight talk and heartfelt inspiration mobilized the troops for Bernie that day.

We were fortunate to hear Nina introduce Bernie again--and all because we made that first trek in the dark and cold to Cleveland. After the Baldwin-Wallace rally, I was fortunate enough to get down to the floor to shake Nina's hand and chat with her for a minute.

 "Nina, you've gotta get Bernie to come to Toledo for a rally!" I shouted over the noise of the crowd. 

"You're right. We need to support our brothers and sisters in western Ohio," she replied.

Sure enough, within a few weeks' time--and with less than 24 hours notice--a Bernie rally was scheduled to take place in Toledo. Along with Bernie and Nina, we also heard from Congresswomen Tulsi Gabbard and Marcy Kaptur, among others. Sort of a "grand slam" of  political celebrities, you could say. 

Without Nina Turner's ever-present support and superb oratory skills, Bernie probably wouldn't have made it as far as he did before the DNC pulled the rug out from under him in the latter half of the 2016 primary season when their chosen candidate was slipping in the polls. It truly was a crime when the DNC leadership refused to allow Nina on stage to introduce Bernie at the nomination convention in Philadelphia. A knife in the back would have been kinder, in my opinion.

To say I'm a "big Nina Turner fan" is an understatement. Even after Bernie Sanders called it quits in 2016, I still harbored much respect and affection for Nina. I've kept up with her work as the first president of Our Revolution, and secretly hoped she would run for a statewide office (like governor) so I could vote for her. Finally, she's taking the plunge--only she's running for US Congress from Ohio 11th district (eastern side of Cleveland to the Akron area). Alas, I live in Ohio's 9th congressional district across the state. So close and yet so far!

While I'm excited to see Nina Turner running for Congress--as she will be a much needed progressive voice there--I won't lie to you. I'm very disappointed to see her running in the Democratic Party primary. Didn't she learn anything about the dirty Dem's duplicity during her time with Bernie Sanders' two presidential campaigns? The Democratic Party leadership have already provided obvious clues that they've chosen their candidate (Shontel Brown) to replace Rep. Marcia Fudge, who will be stepping down to serve in the Biden administration. And after Nina recently spoke at the virtual (online) convention for the Movement for a People's Party, the DNC isn't going to be happy about her openly siding with a new progressive party.

Oh, Nina! Nina! Nina! I feel like crying out. Why can't you run as an independent, a Green, the first big name under the People's Party banner or a Party for Socialism and Liberation candidate instead? Anything except one of those not-to-be-trusted Dems.

The next couple of months will be decisive. Nina will know for certain who all she'll be up against in the Democratic Party primary before too long. Biden will be installed as the next paid-off puppet of the oligarchy in D.C. on January 20. The People's Party has formed officially and been registered in its first state (Maine) and is working hard to do the same in many others. The Green Party US is mopping up after the bloodbath of ballot banishing in several states (including Ohio) and congratulating the many Greens who beat the odds and were successfully elected to local offices. Progressives and their organizations are in a state of flux presently. All is not lost, but things do need improvement.

By the time the special election to replace Rep. Fudge's vacated seat rolls around this spring, we should know more about the lay of the land. Nina could have changed her mind about running in the Democratic Party primary at that point. We'll see. My fingers are crossed that she'll win whatever primary she enters and then the special election and then be seated in Congress. After all, that's where Senator Bernie Sanders first entered the national stage--and just look how far he's come. 

I hope that one day soon we'll be able to call our favorite truth-teller, "President Nina Turner." And we'll be chanting joyfully together once more: Nina! Nina! Nina!

Tell Congress NOT to cut endometriosis funding!

Dear Speaker Pelosi, Leader McConnell, Chairman Shelby, Vice Chairman Leahy, Chairwoman Lowey, and Ranking Member Granger:

As advocacy organizations and individuals that understand firsthand the pain and hardship endured by those living with endometriosis, we urge you to support the requests led by Representatives Finkenauer and González-Colón along with Senators Romney and Warren to prioritize funding for endometriosis research in the upcoming fiscal year. Specifically, we ask that you increase funding for the National Institute of Health National Institute of Child Health and Human Development (NICHD) to at least the levels included in the House-passed bill as well as include report language that lists endometriosis as an eligible condition under the Department of Defense Peer-Reviewed Medical Research Program (PRMRP).

Endometriosis affects about one in ten women, can cause intense pain, and is a leading cause of infertility. Despite its prevalence and health impacts, too little funding has been dedicated toward better understanding, diagnosing, and treating this condition. Many women who live with endometriosis go for years, seeing multiple doctors and even spending thousands of dollars, before they can get a diagnosis and treatment. Women with endometriosis lose an average of six hours of productivity per week at work and the condition is estimated to cost over $78 billion annually in healthcare expenditures and lost productivity. Medical research is the key to finding better ways to diagnose and treat this common and life-altering condition.

Specifically, we request:

  • Inclusion of endometriosis as eligible for funding under the DOD PRMRP in FY 2021. We are concerned by the report put forth by the Senate Appropriations Committee, which does not include endometriosis among the condition eligible under the PRMRP. Endometriosis was included in both FY 2018 and FY 2020, and this opportunity for investment in endometriosis research through the PRMRP must remain available. When research funding is low or inconsistent for a medical condition, it is difficult to attract researchers to specialize in that condition or apply for related research grants and we respectfully ask that you reinstate endometriosis as an eligible condition for FY 2021.
  • The highest possible funding level for the National Institute of Child Health and Human Development (NICHD) in final FY2021 appropriations legislation to ensure that resources are available to double funding for endometriosis research from the FY 2019 level and increase funding for endometriosis for $26 million. We appreciate efforts in both the House and Senate to increase funding for NICHD in FY2021 and ask that the highest possible increase be preserved in the final legislation.

Over 6 million people in the United States are living with endometriosis and our members know firsthand how endometriosis affects the lives of these women and their loved ones. The critical issues that face women with endometriosis need to be addressed and require quick, decisive action to increase research and awareness. As such, we ask that you provide increased funding better to diagnose and treat this condition.

In a stunning recently-leaked video, Joe Biden is heard telling civil rights leaders that they should be satisfied with his rhetorical acknowledgment and expect nothing more. Biden screams at them saying that he will not be using his executive powers to stand up for the Black community that worked hard to elect him — or any other working-class community. This is a huge development because progressives had rested what little hope they had for Biden on the possibility of executive orders — hopes that Biden just smashed as he said he would only be undoing Trump orders.

Adding insult to injury, Biden nominated dairy industry lobbyist and former Obama Agriculture Secretary, Tom Vilsack, to head the department again. "Vilsack is a rerun of pro-corporate policies that continue to drive rural communities away from the Democratic Party," said The Intercept.

Biden and Harris are determined to convince you that their cabinet of lobbyists "looks like America." The first Latino Secretary of Health and Human Services, the first woman to run the Treasury, the first all-female communications team, the youngest national security advisor in decades. But what difference does it make if your family's poverty, hunger and homelessness are imposed by a Black, Latino or White person? We already have a Republican Party. What actually is the point of the Democratic Party?

If confirmed, Vilsack will face one of the worst American hunger crises since the Great Depression, with a surge in food prices, COVID-19 cases, unemployment, and food lines running for miles. Instead of using his Obama-era experience to help minority-owned or small farms, Vilsack has used the intervening years to lobby for the corporate American Farm Bureau Federation and the U.S. Dairy Export Council, where he is currently the CEO. The USDA has been almost exclusively led by white men and has systematically discriminated against Black farmers by giving them less federal aid than White farmers.

Vilsack's nomination also risks the loss of one or both of the Senate seats in Georgia's special runoff election because of depressed turnout. He is loathed by progressives in the state for his ouster of civil rights leader Shirley Sherrod while heading Georgia's USDA department of rural development. Vilsack fired her after a deceptively-edited video on Breitbart said she was racist.

This administration is shaping up to be a mash-up of the Obama, Geroge W. Bush, and Clinton administrations. The only difference is they've all had more time to deepen their corruption as corporate lobbyists in the private sector. If it sounds like the country is moving backward, it's because it is. And the Peoples Party is going to turn that around.
